How the computation works
13th month pay is the total basic salary earned during the calendar year divided by 12. Basic salary means the cash wage only. The value of meals and lodging you provide a live-in kasambahay, cash gifts, overtime pay and holiday premiums are all left out. A helper who worked the full year at ₱7,000 a month earns ₱84,000, so their 13th month pay is ₱7,000. A helper hired in the middle of the year gets a smaller, pro-rated amount because only the months they actually worked are counted.
Paying it correctly
- Deadline. Pay it on or before 24 December, per Presidential Decree 851 and the DOLE labor advisory issued each year.
- Mid-year departures. A kasambahay who resigns or is let go gets their pro-rated 13th month pay as part of their final pay, not in December.
- Tax. 13th month pay and other benefits are tax-exempt up to ₱90,000 per year, which covers virtually every household employee.
- Proof of payment. Have them sign a simple receipt or payslip showing the period covered and the amount, and keep a copy with their Batas Kasambahay contract.
